Memorandum of Understanding Concerning Baseline Terms for All Newly Accreted Position Titles
This Memorandum of Understanding (“MOU”) is entered into this 27th day of October 2023, between the Chicago Board of Education (“Board”) and the Chicago Teachers Union (“CTU” or “Union”) (collectively, the “Parties”).
WHEREAS, the Board and the Union are parties to a collective bargaining agreement effective July 1, 2019 to June 30, 2024 (“CBA”); and
WHEREAS, Article 1-1.2 of the CBA is entitled “Reclassifications and New Job Titles or Categories of Positions” and provides,
If the BOARD reclassifies job titles or categories of positions or employs a new job title or category of position having a community of interest with employees in the existing bargaining unit, employees in such new job title or category of position shall be included within the existing bargaining unit. Upon the UNION’s request, the parties shall negotiate the terms and conditions of employment for such new or reclassified title or category of position. Nothing contained in this subsection shall be construed to require renegotiation of terms and conditions of employment applicable to employees in an existing bargaining unit as a result of the BOARD’s reclassification of the title or category of employees in the unit.
NOW, THEREFORE, the Parties agree as follows:
CBA Terms Apply. Except as provided otherwise in this MOU, all terms of the CBA applicable to all CTU bargaining unit members shall be applicable to employees in any position title certified and/or voluntarily recognized to be included within the existing bargaining unit immediately upon certification or voluntary recognition.
Terms to be Bargained Upon Recognition. Subject to the provisions of this MOU, terms and conditions of employment for newly recognized bargaining unit positions concerning salaries, work year, work day, and evaluation will be bargained in good faith by the Parties.
Interim Salary Terms. Upon recognition and until bargaining has concluded, employees in newly recognized bargaining unit positions shall maintain their existing rate of pay, except that they shall be entitled to the annual cost of living adjustment raises provided under the CBA as noted in paragraph 4.
COLAs and Pension Pick-up. Upon recognition and until bargaining has concluded, employees in newly recognized bargaining unit positions shall be entitled to the annual cost of living adjustment (“COLA”) raises and pension pick-up terms provided for under the CBA.
Health Insurance. All health insurance benefits available to bargaining unit employees shall be available to employees in newly recognized bargaining unit positions immediately upon recognition.
Evaluation. Upon recognition and until bargaining has concluded, the Board shall maintain the status quo terms concerning performance evaluation for employees in newly recognized bargaining unit positions, and the Board shall bargain in good faith with the Union over any potential adverse employment action connected to performance evaluation.
Maintenance of Standards. Upon recognition and until bargaining has concluded, the Board shall maintain the status quo as to all other terms and conditions of employment for employees in newly recognized bargaining unit positons, except as provided otherwise in this MOU.
Effectiveness. This MOU shall remain effective unless and until it is modified by written agreement of the parties incorporated into a successor to the 2019-2024 CBA. Initial - Libby N. Massey
